Please read these terms carefully. Disputes arising from these Terms are resolved through arbitration as described in the Disputes section below, unless you choose to pursue relief before a consumer forum as provided under Indian consumer protection law.
Thank you for using AKTEL Fiber’s business products, equipment and services (“Services”). The Services are provided by AKTEL Fiber Private Limited (CIN: U64100JH2022PTC018163), a company incorporated under the Companies Act, 2013, having its registered office at Shop No 10, Astha Vijay, Uliyan Main Road, P.O & P.S Kadma, Jamshedpur, Purba Singhbhum, Jharkhand, India, 831005 (“AKTEL Fiber”, “we”, “us” or “our”). AKTEL Fiber provides internet services under a Unified License (ISP Category-C authorization) granted by the Department of Telecommunications (License No. DS-11/138/2023-DS-III dated 26.06.2023), for the Jamshedpur Secondary Switching Area in the Bihar Telecom Service Area.
These Business Terms of Service (“Terms”) govern your use of AKTEL Fiber’s business internet products and services. By agreeing to these Terms, you represent that you are at least eighteen years old and capable of entering into a legally binding agreement on behalf of yourself and others in your business who may use the Services.
By signing up for or using the Services, you agree to these Terms.
We may be required to provide certain disclosures, notices and communications (collectively “Communications”) to you in written form. We will deliver such Communications to you in electronic form, and your agreement to these Terms confirms your consent to receive such Communications electronically. Communications include:
Communications will be considered received by you upon delivery by any of the following: posting to your online account or the customer portal at customer.aktelfiber.in; posting on the AKTEL Fiber website; emailing the address associated with your account; sending a text message (SMS) to your registered mobile number; or otherwise communicating via the Services.
To access and retain electronic Communications, you will need a computer or mobile device with internet connectivity, a current web browser, software capable of opening PDF documents, and access to the email address and mobile number associated with your account. We reserve the right to suspend your use of the Services if you decline or withdraw consent to receive electronic Communications, except that you may decline to receive telephone calls and text messages without your Services being affected, as set out below.
On occasion, AKTEL Fiber may contact you by telephone call or SMS text message at the number(s) you have provided to us, regarding your account, responses to inquiries you have made, service or maintenance notices, or marketing messages about our Services. Your consent to receive marketing calls or SMS is not required in order to purchase or receive Services. You may opt out of marketing communications at any time by contacting us through the details in the Contact Us section below, without affecting your ability to receive Service-related and billing notices.
You may apply for Services online or through our sales and support team. AKTEL Fiber reserves the right to determine whether Services are available at a particular address, based on network coverage and technical feasibility.
If AKTEL Fiber determines that the address at which you receive Services is not a business address, we may require you to transition to a different plan or account type, which may include a change in fees.
You agree to provide AKTEL Fiber with the access necessary to your premises so that the equipment required to deliver the Services may be installed, configured, maintained, or repaired. You agree that AKTEL Fiber may install equipment on the exterior and interior of your premises (including running fiber drop cable, ONT/ONU units, and associated wiring) at reasonable locations, and may take photographs of the installed equipment for quality control purposes.
If you rent or otherwise do not own your premises, you represent that you are authorized by the property owner to request installation, and you may be asked to provide written evidence of that permission. If AKTEL Fiber incurs any costs or losses because you did not obtain the necessary permission for installation, maintenance, or repair, you are responsible for reimbursing us for those costs. Acceptance of these Terms does not guarantee that AKTEL Fiber will install or provide Services at your address; a separate installation or service agreement may be required.
AKTEL Fiber may provide or rent equipment (such as an ONT, router, or switch) to you in connection with the Services. If you lose or damage this equipment after installation, we may charge a replacement or repair fee in accordance with our published fee schedule, which is subject to change.
Unless stated otherwise, AKTEL Fiber owns all equipment we provide in connection with the Services. You authorize AKTEL Fiber to install firmware and software upgrades on any equipment we provide, and you agree not to use AKTEL Fiber-owned equipment for any purpose other than receiving the Services.
The Services may be subject to additional one-time or recurring fees (such as installation, static IP, or relocation charges), as set out in our current fee schedule or your service order.
When you subscribe to AKTEL Fiber Business, you do not enter into a fixed-term service commitment and are free to cancel at any time, subject to the Changing and Canceling Services section below. You agree to pay recurring Service fees in advance of the billing cycle in which you receive the Services, so a cancellation request will take effect at the end of the current billing cycle.
When you subscribe to AKTEL Fiber Business, you will receive a dynamic IP address and, depending on your plan, you may also receive one or more static IP addresses. For an additional monthly fee, you can purchase additional static IP addresses. If you choose a static IP address option, we will register the IP address(es) against the business name and address you provide at sign-up, in accordance with the applicable Regional Internet Registry (APNIC) allocation and registration policies. Contact our support team if you’re unsure whether a static IP is right for your business.
You may use your own router instead of one provided by AKTEL Fiber. If you do, you are responsible for ensuring it is configured correctly and used in accordance with these Terms, including our Acceptable Use Policy. We cannot guarantee compatibility with every router, and our support team may not be able to troubleshoot third-party equipment. We suggest using your own router only if you’re comfortable managing it independently.
You agree not to misuse the Services — including using them for purposes that are unlawful, infringe the rights of others, or adversely affect other users’ enjoyment of the network. Examples of prohibited activities are set out in our Acceptable Use Policy, which is incorporated into these Terms by reference. You are responsible for all activity on the Services, whether undertaken by you or by anyone else using your connection.
You agree not to provide the Services, directly or indirectly, in hotel rooms, hostel or dormitory rooms, private hospital rooms, or shared/rented office spaces paid for by third-party customers. You may, however, provide the Services in common areas on your premises, such as lobbies or waiting areas.
If you use the Services at a premises you do not own or control (such as a shared office, mall, or business park), any agreements you have with the property owner or manager are separate from these Terms; AKTEL Fiber is not a party to, and is not bound by, such agreements. You may not use our branding or logos to market or advertise your own business.
The Services are intended for use by you, your employees, your customers, and other users in the ordinary course of your business. You agree not to resell or repackage the Services, or otherwise make them available to anyone outside your premises, without our prior written consent.
AKTEL Fiber takes reasonable steps to keep its network secure, but no network security is perfect. You are responsible for implementing appropriate security measures on your own devices and network, including ensuring your data is not accessed by unauthorized third parties. AKTEL Fiber is not responsible for damages caused by unauthorized third-party access to your devices or data.
AKTEL Fiber takes your privacy seriously. Information provided to and collected by us in connection with the Services is handled in accordance with our Privacy Policy and applicable Indian data protection law, including the Information Technology Act, 2000 and rules made thereunder, and the Digital Personal Data Protection Act, 2023.
You agree to pay all applicable fees for the Services you purchase, whether ordered by you or by someone authorized to use your account. Invoices, including applicable GST, will be made available through the customer portal at customer.aktelfiber.in and/or sent to the email or mobile number associated with your account.
You agree to pay recurring Service fees in advance of the billing cycle in which you receive the Services; one-time charges are billed in the cycle following your authorization of such charges. You authorize AKTEL Fiber to collect payment through your chosen payment method (such as UPI, net banking, card, or another supported method). If payment is not received, AKTEL Fiber may, consistent with applicable law, charge late payment fees and/or suspend the Services if payment remains more than thirty (30) days past due. If Services are suspended and you request reinstatement, we may charge a reconnection fee.
Where a third-party payment gateway is used to process your payment, your use of that gateway is also subject to its own terms and privacy policy, which AKTEL Fiber does not control. If you pay using a corporate card, you confirm that you are doing so with your employer’s authorization.
You may change or cancel your Services at any time by contacting our support team, but you may be required to return any AKTEL Fiber-owned equipment. If equipment is not returned, we may charge a replacement fee. Where you upgrade or downgrade your plan, fees will be prorated based on the date the change takes effect.
If you cancel all Services, they will remain available until your selected cancellation date. Once disconnected, any credit for the remaining portion of the billing cycle will be applied to outstanding balances, and any remaining credit balance will be refunded to your last used payment method. AKTEL Fiber reserves the right to suspend or terminate Services for breach of these Terms, non-payment, or misuse, in accordance with applicable law.
AKTEL Fiber is committed to online safety for minors and complies with applicable Indian law relating to the protection of children online, including reporting obligations under the Protection of Children from Sexual Offences (POCSO) Act and the Information Technology Act, 2000. We use reasonable network management techniques to protect our network, equipment, Services and users from harm, ensure reliable service quality, and comply with applicable regulatory requirements, including those prescribed by the Telecom Regulatory Authority of India (TRAI) and the Department of Telecommunications (DoT).
We provide the Services using a commercially reasonable level of skill and care. However, other than as expressly set out in these Terms or a separate agreement provided to you, AKTEL Fiber does not make specific promises about the Services or any equipment provided, including their reliability, availability, or fitness for a particular purpose.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS, THE SERVICES AND EQUIPMENT ARE PROVIDED “AS IS,” AND TO THE EXTENT PERMITTED BY LAW, AKTEL FIBER EXCLUDES ALL IMPLIED WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE EXTENT PERMITTED BY LAW, AKTEL FIBER’S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM (OR, AT OUR OPTION, TO SUPPLYING THE SERVICES AGAIN).
AKTEL FIBER WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE, AND WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EXCEPT WHERE SUCH EXCLUSION IS NOT PERMITTED UNDER APPLICABLE INDIAN LAW, INCLUDING THE CONSUMER PROTECTION ACT, 2019.
